Holiday Accident Compensation

It’s bad enough having an accident in the UK but to have an accident abroad is one of the things that we all hope will never happen to us. However, these things can happen and when they do, you need to know that there is help available so you can fully focus on your recovery.

Simpson Millar LLP has helped hundreds of people following their accident abroad. Our travel lawyers have actively supported all their clients and families during the difficult times following the accident. Regardless of where your accident occurred we are able to provide helpful advice and assistance when you most need it.

As specialists in travel law and with over 30 years combined experience within the travel industry we are very well placed to determine what action you can take following your accident abroad, the amount of any compensation you may be entitled to and to make sure you can move forward after the incident.

We offer a free telephone consultation service for those holidaymakers that have suffered an injury abroad following an accident. Call one of our specialist holiday lawyers if you would like to learn what options are available for taking action against your tour operator.

What is Holiday Accident Compensation?

If you have had an accident on holiday your insurer may only agree to pay for your medical expenses and, if you are lucky, any loss of earnings that you suffer.

Should the operators of the hotel, campsite, aircraft, vehicle or cruise liner be to blame for your accident then you are entitled to claim compensation for any losses that your holiday insurance will not cover.

Compensation for accidents that occur abroad differs from accidents that happen in the UK because you could potentially claim for further compensation for the fact that you weren’t able to enjoy your holiday.

I’ve had an accident. What can I claim for?

  • The proportion of the holiday that was ruined by your accident
  • The loss of enjoyment from your holiday
  • The pain and suffering caused by the injury
  • Compensation for other members of the holiday party because your accident ruined their holiday
  • Any foreign medical expenses (not covered by your insurance)
  • Out of pocket expenses including car hire, child care, and additional accommodation costs
  • Out of pocket expenses once you have returned home to the UK
  • Compensation for loss of earnings whilst you are unable to work
  • Compensation for any professional care received or care offered to you by your family
  • Your insurance excess
