A lady from West Sussex has successfully sued her Travel Agent for gastroenteritis suffered during a holiday to Turkey with Co-operative Travel (Co-op travel).
Gastroenteritis is an infection that causes sickness and diarrhoea and, according to a leading gastric illness expert, results in between five and eight million fatalities every year. Left untreated the victims can be left with kidney problems and long term symptoms such as irritable bowel syndrome.
Mrs Jewell from Crawley was enjoying the all-inclusive facilities at the Onyria Claros Beach and Spa in Ozdere Turkey when she was suddenly struck down with severe stomach pains and diarrhoea.
Owing to the severity of her symptoms her husband visited the hotel nurse who advised him that she need to visit the local hospital as quickly as possible.
Whilst in hospital Mrs Jewell was placed on a drip where antibiotics were applied and stool and blood samples were taken. Luckily the treatment seemed to relieve her symptoms which meant she was able to travel back to the UK on her intended flight.
Upon her return to the UK she instructed Paul Stevens of Simpson Millar LLP to help her with a compensation claim against Co-op Travel.
Once instructed Paul was able to make sense of the complex legal issues in order to the rule out the possibility that the Co-op were only acting as a ticketing agent – and were in fact the organisers for the package holidays. Co-op Travel are part of the Thomas Cook Group of companies.
Paul was able to arrange a telephone consultation with a food poisoning expert to enable to prove her claim.
The Defendant instructed Central London Law firm to represent them who sensibly advised Co-op Travel to agree compensation with Mrs Jewell. Compensation was agreed at £4000.00 for the loss of enjoyment and distress caused by the illness.
Paul Stevens advised:
"Mrs Jewell did all the right things to safeguard her safety whilst on holiday which, in turn, meant she had good grounds for making a claim when she arrived back in the UK."
"Even though she did not receive the results of her stool samples, she was able to point to health and safety failings within the hotel such as unrefrigerated pancake mixture and a poor standard of cleanliness in the hotel restaurant."
"Mrs Jewell’s astute observations were very helpful in enabling us secure the compensation she deserved".
"While we got there in the end, a number of complex legal hurdles had to be overcome. I was very pleased with the outcome of this case for Mrs Jewell."
