Northeast Lady Successfully Sues Thomas Cook for Holiday Illness

A lady from Tyne and Wear has successfully claimed compensation from Thomas Cook for illness at the Melia Las Dunas Hotel in Cuba during her summer holiday.

Mrs Butler travelled as part of a wedding party to the ever popular destination of Cayo Santa Maria in Cuba. She travelled to the hotel on an all-inclusive basis and during the course of her stay, she was struck down with a bout of sickness and diarrhoea and her holiday was ruined.

Dismayed that her family holiday was spoilt she contacted the UK’s Leading Travel Law Firm, Simpson Millar, to represent her in a claim against Thomas Cook for the illness bug that she suffered from.

Once Thomas Cook had received details of the claim from Simpson Millar, Thomas Cook agreed to settle the claim with compensation in line with what she would have received if the matter had ended up proceeding to a court hearing.

As she did not test positive for any kind of germ, it could have been the case that Mrs Butler had difficulty proving her claim. However, through the expertise of her lawyers, Thomas Cook buckled and agreed an appropriate compensation award.

Upon receiving her compensation, she said of Paul Stevens, the travel lawyer responsible for conducting her claim:

“I was very happy with the service Paul Stevens provided. He was very professional in every way.”

Paul added:

“Thomas Cook made the sensible decision to promptly settle my client’s claim. In this instance they took the view that it was in their interest and our client’s interests to avoid matters becoming escalated.”

“My client made use of a no win no fee funding agreement that we were able to offer which meant she kept all of her compensation as Thomas Cook agreed to pay for her legal costs”.
