Liverpool Lady wins £4,000 In Accident Claim against Thomas Cook

A lady from Liverpool has successfully sued Thomas Cook for an accident at hotel that was sold to her as part of a package holiday.

Ms S Snowden sustained a soft tissue injury to her shoulder when she slipped due to the presence of liquid, when entering the ladies toilet at the hotel where she was staying at.

She was able to take legal action against Thomas Cook Tour Operations Ltd because under the 1992 Package Travel Regulations, it is possible to bring an action against the holiday company responsible for the organisation of the holiday.

As Thomas Cook had sold the hotel as part of a package holiday which included flights and accommodation, Ms Snowden could sue her tour operator.

During the court hearing the judge heard how the accident ruined Ms Snowden’s holiday due to her falling heavily on her back, neck and shoulder as she fell in a backwards direction. She had to be taken to hospital while on holiday and once she returned to the UK, it transpired that the accident had caused a worsening of her pre-existing lower back pain.

The judge awarded Ms Snowden over £4,000 in compensation for her holiday accident.
